Introduction

This section contains information about the fundraising platform we provide. It also explains how to access and register with the platform and provides links to our policies and guidelines. These apply to your use of the platform including the types of content you are permitted to post, the types of Campaigns and related rewards we permit you to offer and what we do with any personal information we collect as you use the platform.

Please note that CanDo does not offer regulated investments through the platform. Therefore it is not authorised or regulated by the Financial Conduct Authority. As with all rewards based crowdfunding, there is no recourse to either the Financial Ombudsman Service or the Financial Services Compensation Scheme.

1 Welcome

1.1 Welcome to CanDoAction.org. The CanDoAction.org platform and the services provided through it are operated and owned by CanDo International Ltd (“we”, “us” or “our” as appropriate). For further information about us please visit the About Us page and to contact us visit, Get in Touch.

1.2 To make these Terms quicker to read, we use a few key definitions: we refer to our users that are seeking to raise funds and offer Rewards for doing so as “Local Humanitarian Partners”, their fundraising projects as “Campaigns”, the aims of a Campaign as its “Campaign Story”, those users that support Campaigns by contributing funds as “CanDoers”, their donation as “Contributions”, the minimum total value of Contributions sought by a Local Humanitarian Partner for a particular Campaign as the “Fundraising Goal”, the maximum period for which Contributions can be made for a Campaign as the “Fundraising Period” and the total value of Contributions (excluding cancelled Contributions) that a Campaign has received at the end of the Fundraising Period as “Total Contributions”. Campaigner and other visitors to the site are referred to as “Users” or “you”, as applicable. The Campaign will be deemed to be funded if at the end of the “Fundraising Period”, the Campaign reaches its “Fundraising Goal” by the specified date under the ‘all or nothing’ payment scheme.

All or nothing’ You only receive the funds raised if you hit your target (if you don't hit target, funds are returned to the CanDoers). This payment scheme is best suited for Campaigns that need to reach a set target to take place. 

1.3 We provide a platform for individuals and organisations registered with CanDoAction.org (“Campaigner”) to raise funds for Campaigns that have a health focus / benefit to their community. The platform allows Local Humanitarian Partners to offer unique items, services or experiences (“Rewards”) as ‘thank you’ gifts for this support and also provides them with an opportunity to build a community around each Campaign by promoting it on the platform and on certain social media sites to friends, family and other supporters.

1.4 These Terms of Use are organised into 2 sections, Section A applies to all Users, whether a Campaigner or those just visiting. Those in Section B apply specifically to Local Humanitarian Partners. 

1.5 Please read these Terms carefully before you start to use CanDoAction.org, as they will govern your use of CanDoAction.org, the Campaigns and Rewards that you create and offer as a Local Humanitarian Partner and the Contributions you make as a CanDoer, as well as the content you post as a user. We recommend that you print or save a copy of these Terms for future reference.

1.6 By using CanDoAction.org, you confirm that you accept these Terms and that you agree to comply with them. If you are using CanDoAction.org in connection with your organisation, the terms 'you', 'your' or 'your organisation' in these Terms are also a reference to the business, charity institution or other organisation or entity (“Business”) on whose behalf you act when using, registering, supporting or creating a Campaign on CanDoAction.org. If you do not want to be bound (or your Business to be bound, where applicable) by these Terms please do not access, use and/or contribute any content to CanDoAction.org or interact with its Campaigner.

2. Accessing and using CanDoAction.org

2.1 Anyone can access CanDoAction.org. However, to post a Campaign and become a Local Humanitarian Partner you will need to register as a CanDo partner by signing up and creating an account. CanDoers do not need an account to make a contribution, however to be in contact with any Campaigner, be part of our Humanitarian movement or keep informed of CanDo’s activities you will need to create an account via our Join Us link.

2.2 You are not eligible to use CanDoAction.org if we have temporarily suspended or previously terminated your access to the platform and we have not expressly authorised you in writing to resume using CanDoAction.org.

2.3 We try to make CanDoAction.org available at all times, but, of course, we cannot guarantee this.

3. Your privacy and our use of cookies

3.1 We take your privacy very seriously. Please read our Privacy Policy to see how we use your personal information.

3.2 Like many online services we use a feature called a 'cookie', which is a small data file that is sent to your browser from a web server and stored on your device's hard drive. References in these Terms to ‘cookies’ also include other means of automatically accessing or storing information on your device. By agreeing to these Terms, you are providing your consent for us to use cookies in the ways described in our Privacy Policy, however, you may delete any of these cookies at any time if you wish.

Please see our Privacy Policy for detailed information on the types of cookies we use on CanDoAction.org, the purposes for which we use each cookie, how you can disable and enable the use of certain cookies and the consequences of doing so.

4. Account registration

4.1 You can create your account on the Join Us page. You can also use the link on that page to create an account with CanDoAction.org by linking your Facebook account using the ‘Facebook Connect’ facility. Whether using the standard registration process or registering using Facebook Connect, you will be asked to confirm your account by clicking a link in an automated email sent to you.

4.2 You must make sure that all the information you provide when you register with CanDoAction.org is true, accurate and current and complete.

4.3 If you change any of your registration details (e.g. email address, address), you must update your account.

4.4 Your account is for your personal use only. To help us maintain the security of CanDoAction.org, you must keep your login details confidential. Please do not share your login details with any other person or leave your device unattended whilst logged into CanDoAction.org as you will be held responsible for all activities that occur under your password or account (with or without your knowledge) as a result of doing so. If you become aware of any misuse or unauthorised use of your login details, then you must inform us immediately by sending an email to help@candoaction.org.

4.5 In the event that you have, or we have reason to believe that you have breached, or will breach these Terms, we may terminate or suspend your registration and/or access to CanDoAction.org and/or to any content made available on CanDoAction.org.

4.6 You can request deletion of your account at any time as long as you do not have any active Campaigns or any outstanding Rewards or Contributions relating to unexpired Campaigns you have backed. Please contact us to request deletion of your account.

4.7 We reserve the right to delete your account. Any personal data or other information associated with your use of CanDoAction.org will be held securely and in accordance with the UK Data Protection Act 1998.
 

Creating Campaigns, offering rewards and making Contributions

This section sets out the terms that apply to the Campaigns that your create and the rewards you offer or the Contributions or other contributions you make in support of Campaigns.

1. Our role
1.1 What we do

1.1.1 We provide a platform through which Campaigner can raise finance for their community-focused Campaigns and offer Rewards or make Contributions for Campaigns and receive Rewards. By doing so and providing tips and other guidance we facilitate agreement between Local Humanitarian Partners and CanDoers for Contributions and Rewards on terms agreed between them.

1.1.2 Although we may promote and advertise certain Campaigns or help to raise awareness of their Campaign Story, we will not be involved in the management of or use of Contributions in relation to a Campaign nor will we directly offer or fulfil Rewards ourselves.

1.2 What we don’t do

1.2.1 Other than as mentioned above, we do not have any involvement in any arrangements Campaigners make with each other through CanDoAction.org. We therefore do not accept any responsibility for the nature or quality of a Campaign performance or any Rewards or returns, nor do we promise that any member of the platform, whether Local Humanitarian Partner or CanDoer, will do as they promise. The arrangements you make are solely private and the contracts relating to Campaigns, Contributions and Rewards are made directly between the individual parties concerned. Accordingly, when using CanDoAction.org, you take full responsibility for your arrangements with other Campaigner whom you contact and the nature, terms and extent of your arrangements with them and obligations to them.

1.2.2 We however, verify the identity of our Campaigners and ensure they complete a full assessing and vetting procedure. For more details on this process you can read more in our FAQs or contact our Partnership manager. 

2. Local Humanitarian Partners
2.1 Creating and updating Campaigns

2.1.1 Once you have registered as a Campaigner, you can create and post details of your Campaign to a publicly accessible webpage on CanDoAction.org (“Campaign Page”) using the functionality we provide.

2.1.2 We have specific criteria regarding the types of Partners and Campaigns that you can post to CanDoAction.org. Please see our information in our Local Humanitarian Partners page, which outline this criteria and form part of our Terms.

2.1.3 We suggest you do not raise funds via another online crowdfunding or similar platform (whether platform or App) during the Funding Period of your Campaign.

2.1.4 Although we recommend you have no more than one active Campaign at any one time, we permit you to post as many active Campaigns as you like.

2.1.5 Campaigners are categorised into tiers as to what Fundraising Goal limit they are allowed for each Campaign. The tier system is based on their organisational capacity assessed during our new partner process. If you are a Local Humanitarian organisation, please take this into account when calculating the Fundraising Goal for your Campaign.

2.1.6 For All or nothing Campaigns the Fundraising Period is usually set to 6 weeks unless specifically agreed by us otherwise in writing.

2.1.7 Your Campaign may take up to 5 working days before it goes live and your Campaign Page is made available on CanDoAction.org. From time to time, we may provide a Crowdfunding coach (“Coach”) to provide guidance relating to your Campaign, think of ideas for Rewards and offer tips for marketing and press exposure. If we do so, your Coach will usually be assigned to you within 2 days of submitting your Campaign details. Please note that Coaches provide general guidance and information only and neither they nor us will be liable to you in connection with the Campaign Story, any Campaign, Rewards, performance and/or promotion and marketing of your Campaign, which remain solely your responsibility. 

2.1.8 Once you have submitted your Campaign details for posting you cannot change its Campaign Story, the Fundraising Goal or the Fundraising Period. You can however change the Rewards for your Campaign provided that you have not received any Contributions.

2.1.9 You may post content and other material (e.g. promotional material such as a video containing your Campaign) and post Campaign updates to keep CanDoers updated on the performance of your Campaign.

2.1.10 If you are using 'All or nothing' You may withdraw a Campaign at any point before the end of the Fundraising Period. Once you have done so, you will not be entitled to any Contributions when you withdraw. You may not be able to resume that Campaign at a later date whilst retaining any of the Contributions you had received at the time of withdrawal. 

2.1.11 We reserve the right, but are not obliged, to attempt to verify your identity and other information you provide to us and to reject, cancel, interrupt, remove, or suspend an active Campaign at any time and for any reason. In particular, Campaigns or Contributions that are flagged to us as fraudulent by CanDoers or our third party payment providers will be subject to review. If we find fraudulent Contributions have been made to your Campaign, we will cancel those Contributions and the details of the associated CanDoer from your Campaign Page.

If, in our sole discretion, we determine your Campaign to be a high fraud risk we may also ask you for more information and you agree to respond to such requests and provide such information within a reasonable time. We or our payment providers may also perform an examination before any funds are distributed to you. We will not be liable to you for any losses that you suffer or incur as a result of us taking any of the actions in this paragraph 2.1.11.

2.2 Offering Rewards
2.2.1 We suggest that Campaigners offer specific Rewards that are achievable to provide from one country to another.
2.2.2 The minimum contribution amount is £5.00, the maximum amount £5,000.
2.2.3 You can choose whether or not to limit the number of Rewards you offer for each contribution amount.
2.2.4 You must have all the permissions, consents and licences that are necessary to offer all Rewards relating your Campaign before you offer them on your Campaign Page.

2.3 Fees payable by Local Humanitarian Partners and receiving funds

2.3.1 There is no charge for the Campaigner for publishing a Campaign on CanDoAction.org nor are there any fees payable to CanDo.

2.3.2 If your Campaign reaches or exceeds your Fundraising Goal at the end of its Fundraising Period you will cover any fees your bank charge to receive the funds into your account. 

2.4 Contributions

2.4.1 Under the All or Nothing funding payment scheme, if your Campaign does not reach its Fundraising Target by the end of the Fundraising Period, any Contributions made by CanDoers for the Campaign will be held and a refund offered, and you will not be entitled to receive any funds in respect of them.

2.5 Local Humanitarian Partners’ Obligations
 

2.5.1 As a Local Humanitarian Partner, you shall:

(a) apply any funds you receive from CanDoers solely and directly for the purposes of achieving the Campaign Story and use them for no other purposes;

(b) meet all commitments you make in your Campaign including, but not limited to, delivering all Rewards you offer to CanDoers;

(c) use all reasonable endeavours to fulfil each Reward by the estimated fulfilment or delivery date (as applicable) specified by you in agreement with the CanDoer.

(d) promptly and accurately respond in full and to our satisfaction to all queries, clarifications or requests made by us and/or any CanDoer;

(e) not use any personal information we share with you in connection with a CanDoer for any reason other than fulfilling a Reward or contacting them in relation to the Campaign for which they have made a contribution;

(f) promptly contact and work with CanDoers to reach a mutually satisfactory resolution, which may include refunding their Contributions if you are unable to fulfil any of your commitments (including providing any Rewards);

(g) comply with all applicable laws and regulations in relation to your Campaign, your use of Contributions and offer of and fulfilment of Rewards;

(h) be responsible for paying all applicable taxes (including income tax and VAT or similar taxes) connected with your use of CanDoAction.org, the Contributions you receive and the Rewards you offer.

3. CanDoers
3.1 Types of contribution

3.1.1 CanDoers can make a financial contribution to a Campaign

3.1.2 You acknowledge that your contribution does not entitle you to any rights in or to any Campaign, including any ownership, control or intellectual property rights.

3.2 Making a contribution.

3.2.1 Once you have registered as a CanDoer on the platform, you can make a contribution by visiting the Campaign Story page of a Campaign, selecting the reward or clicking to add an amount you wish to contribute on the payment page.

3.2.2 Your username will be made publicly available in connection with each Campaign for which you make a contribution under the ‘CanDoers’ tab of the Campaign Page unless you choose to make a contribution anonymously.

3.3 Rewards

3.3.1 Whilst making a contribution you can elect to opt out of receiving a Reward.

3.3.2 Once you have made a contribution, you cannot change your selected Reward without cancelling your contribution.

3.4 Payment methods

3.4.1 Once you have confirmed the amount you wish to contribution, you will be prompted to input your credit or debit card details. Please see terms and conditions that will apply to the processing of the payment of your contribution. Any personal information you provide to these payment providers will be processed in accordance with their privacy policies and not ours.

3.5 Refunds

3.5.1 If a Campaign for which you have made a contribution is not deemed funded by the end of the Fundraising Period and is under the All or Nothing funding scheme, your contribution will be held in your BlueSnap e-wallet and you may request a refund.

3.6 CanDoers’ Obligations

3.6.1 As a CanDoer, you shall:

(a) promptly respond to a Local Humanitarian Partner following a request for information reasonably required by the Local Humanitarian Partner to fulfil a Reward that you have chosen at the time you made your contribution;

(b) comply with the terms and conditions for the payment processing services provided by our third party payment providers and

(c) ensure that any funds used to make Contributions will not result in a breach of applicable law.

4. Other important terms
4.1 The contract between Local Humanitarian Partners and CanDoers

4.1.1 The contract relating to the provision of funds from Contributions and the fulfilment of Rewards is made solely between a Local Humanitarian Partner and CanDoers, subject always to these Terms. By making a contribution, a CanDoer is making an offer to enter into a contract with the applicable Local Humanitarian Partner provided that the Local Humanitarian Partner is deemed funded at the end of the Funding Period.

4.2 Interest on Contributions

4.2.1 Any interest on Contributions or other funds held by us shall accrue to our benefit and neither Local Humanitarian Partners nor CanDoers shall be entitled to such interest in relation to distributed funds or refunded Contributions.

4.3 Publication and sharing of personal information relating to CanDoers with Local Humanitarian Partners

4.3.1 Unless you have selected the anonymous donation option, we publish the username of each CanDoer on the Campaign Page and we share these details and each CanDoer’s full name, email address and postal address with the applicable Local Humanitarian Partner for them to fulfil your Reward and to contact you in relation to the Campaign. Please see our Privacy Policy for further details regarding the types of personal information we share with Local Humanitarian Partners and the purposes for which this information will be used.

4.3.2 For some Rewards, a Local Humanitarian Partner may need further information from CanDoers, to enable the Campaign Creator to deliver certain Rewards. The Local Humanitarian Partner shall request such information directly from a CanDoer after the end of the Fundraising Period for the relevant successful Campaign.
